The trucking industry is the backbone of the American economy, responsible for transporting approximately 71% of all freight across the U.S. roads. As the industry evolves, the regulatory landscape continuously changes to improve safety standards and reduce accidents. In this article, we delve into the latest changes in trucking safety regulations and what they mean for truck drivers, fleet operators, and consumers alike.


1. Hours of Service (HOS) Regulations Update


One of the most significant changes came with the Federal Motor Carrier Safety Administration (FMCSA) revising the Hours of Service (HOS) rules. The new regulations, implemented in September 2020, aim to provide more flexibility for drivers while maintaining safety. Under the updated guidelines:



  • Drivers can now take a 30-minute break after eight hours of cumulative driving time, rather than before the eight-hour mark.

  • The adverse driving conditions exception has been extended, allowing drivers to increase their driving window by up to two hours when facing unexpected adverse weather or road conditions.

  • The short-haul exemption has been expanded to include drivers who operate within a 150 air-mile radius from their normal work reporting location and allows a 14-hour work shift without a mandatory 30-minute break.


This update reflects an understanding of the need for flexibility amid long hours and challenging driving conditions while prioritizing safety. Ultimately, it aims to prevent driver fatigue, promoting better concentration on the road.


2. Electronic Logging Devices (ELDs) Requirement


Furthermore, the mandate for Electronic Logging Devices (ELDs) remains a critical regulation affecting the trucking landscape. In 2017, the FMCSA required the use of ELDs to electronically record a driver’s HOS. This regulation has seen a few adjustments over the years:

  • Drivers who are exempt from ELDs must now maintain detailed paper logs that can be electronically reviewed during inspections.

  • Improved ELD technology ensures accurate data collection, minimizing errors that can lead to unsafe driving practices.


The use of ELDs has reduced hours-of-service violations by allowing real-time tracking of driving hours, which is crucial in preventing fatigue-related incidents.


3. Entry-Level Driver Training (ELDT) Standards


Another important regulatory change is the Entry-Level Driver Training (ELDT) rule, which came into effect in February 2022. This rule sets new training standards for individuals seeking a Commercial Driver’s License (CDL). Key aspects include:



  • Mandatory training on critical safety topics, such as vehicle operation, pre-trip inspections, and defensive driving techniques.

  • A standardized curriculum ensures that all entry-level drivers meet a consistent level of knowledge, enhancing their skills before they hit the road.


These new training requirements aim to reduce the number of inexperienced drivers entering the industry, ultimately leading to fewer accidents and improved safety outcomes.


4. Improved Vehicle Safety Standards


Equally important are the improvements in vehicle safety standards. The FMCSA has rolled out regulations requiring advanced safety technologies in commercial motor vehicles. These include:



  • Mandatory electronic stability control systems to prevent rollovers and improve vehicle handling.

  • Rear-visibility technology to aid drivers in avoiding backover accidents.

  • Potential future requirements for autonomous driving technologies, which can significantly reduce human error on the road.


The integration of technology in truck safety protocols supports the goal of minimizing accidents and injuries associated with large vehicles.


5. Drug and Alcohol Clearinghouse Implementation


The Drug and Alcohol Clearinghouse, a national database that tracks drug and alcohol violations among commercial drivers, became fully operational in January 2020. Key features include:

  • Employers must now query the clearinghouse before hiring new drivers and annually for existing employees.

  • Drivers are entered into the clearinghouse if they fail a drug or alcohol test, which impacts their ability to obtain a CDL until they complete a return-to-duty process.


This initiative aims to remove unsafe drivers from the road and create a safer driving environment for everyone by increasing accountability among drivers and employers alike.
